California Court of Appeal Issues Temporary Stay in Pico Neighborhood Association and Maria Loya v. City of Santa Monica

The California Court of Appeal today issued a temporary stay of paragraph 9 of the trial court’s order pending further order of the Court of Appeal.  Paragraph 9 of the trial court’s order prohibited any person who was not elected through a district-based election from serving on the Santa Monica City Council after August 15, 2019.  The City had argued that this paragraph, unless stayed, would effectively require the City of Santa Monica to hold a district-based election this summer.  The Court of Appeals further ordered the respondents (Pico Neighborhood Association and Maria Loya) to file their opposition to the City’s petition for a stay by March 21, 2019, and the City to file a reply on or before March 25, 2019.  Acting Presiding Justice Elizabeth A. Grimes, Justice Maria E. Stratton, and Justice John Shepard Wiley signed the order.
