Builder's Remedy

What is the builder’s remedy?

The Housing Accountability Act, Government Code Section 65589.5 (the “HAA”), includes a special provision [Government Code Section 65589.5(d)], colloquially referred to as the “builder’s remedy”, to encourage housing production that takes effect when a City’s Housing Element is out of compliance. The City of Santa Monica's Housing Element was certified by the State of California Housing and Community Development Department on October 14, 2022. 

The following table provides the status of the Builders Remedy projects as of April 30, 2023.

(Note: the following three projects are not subject to this Settlement Agreement: 1215 19th Street, 1420-22 20th Street, and 1433 Euclid Street).


In compliance with CEQA, a Notice of Exemption and a Notice of Determination was filed for the Settlement Agreement.
